Black Lives Matter demands DA press charges against Bronx officer who killed woman

THE BRONX - Black Lives Matter protesters rallied outside the Bronx District Attorney's Office Tuesday, demanding charges against the officer who gunned down a mentally ill woman in her own apartment. 

NYPD Sgt. Hugh Barry, an eight-year veteran of the force, fatally shot 66-year-old Deborah Danner, who was black, when police say she swung a bat at his head. Barry was placed on modified duty.

The NYPD says it had previously encountered Danner's outbursts and had known of her mental condition. Police Commissioner James O'Neill even said the department had "failed."

Black Lives Matter says it is disappointed by New York Attorney General Eric Schneiderman's decision not to investigate incident and instead leave it in the hands of Bronx DA Darcel Clark.

The attorney general says the case does not fall under his jurisdiction.

The protesters demanded Clark convene a grand jury hearing and charge Barry in connection with the slaying. They also want him fired from the NYPD.

"It's been terrifying for me, being that I'm a young black woman," says Mercy Baez, one of the protesters. "I don't want to be a part of that."

Clark says her office is on the case. 

"I intend to conduct a full, reasoned and independent investigation into this incident, with an open mind," Clark says. "And any decisions that I make will be based upon the evidence."
