THE BRONX - Both sides were back in court Monday over FreshDirect's plan to relocate to the South Bronx.

Oral arguments for both sides were heard at the Bronx Supreme Court. Online grocer FreshDirect wants to build its headquarters at the Harlem River Rail Yards, but opponents want to know if FreshDirect's sublease of the property is constitutional.

Gavin Kearny, of New York Lawyers for Public Interest, says he hopes the judge reopens their motion against FreshDirect. Kearny says they're challenging the legality of public property being put to private use.

FreshDirect defended its plans, saying it wants to build a new facility and create jobs.
