THE BRONX - A former Marine accused of strangling his 74-year-old neighbor in Kingsbridge went before a judge Tuesday.

Joaquin Feliciano is facing charges in the death of his neighbor Felix Rodriguez. Police say Feliciano strangled Rodriguez inside their apartment building on University Avenue. They say Rodriguez was found unconscious on an elevator floor.

According to police, Feliciano was holding the elevator door open for another neighbor. They say that neighbor left and that's when Rodriguez and Feliciano ended up in a shouting match.

Feliciano's lawyer claims his client is being unfairly prosecuted, saying he was simply defending himself from a vicious attack.

Feliciano has been charged with manslaughter. The case goes before a grand jury Monday.
