Deadly Halloween crash suspect returns to court

THE BRONX - The man accused in a deadly Halloween accident two years ago asked to review a grand jury's notes in court Tuesday.

Howard Unger is accused of slamming his car into a group of trick-or-treaters on Morris Park Avenue and killing a 10-year-old girl, her grandfather and a 24-year-old man in 2015. This happened while he was having a seizure.

Unger, who was diagnosed with epilepsy in the 1980s, faces charges of manslaughter, homicide and assault. Prosecutors say the Department of Motor Vehicles had no record of Unger disclosing his medical condition when he applied for a driver's license, potentially leaving him liable for the deaths.

The Bronx district attorney is also accusing him of being negligent when it came to taking his seizure medication. 

Prosecutors say that according to a blood sample taken at Jacobi Medical Center on the night of the crash, Unger had been off his meds for two to three days.

Unger's defense attorney says his client took the drug as prescribed. 

The defendant was released on $75,000 bail and is due back in court on June 14.
