The 16-year-old could face upgraded charges for allegedly setting a mattress on fire because he was bored.

BROOKLYN - The teenager accused of setting a fatal fire in Coney Island last weekend is now facing a charge of felony murder.

Marcell Dockery, 16, has already been charged with assault, arson and reckless endangerment. He has now been charged with second-degree murder for allegedly setting a fire that resulted in the death of an NYPD officer.

Brooklyn District Attorney Ken Thompson said, in a statement, "The senseless act of setting that fire tragically led to the death of NYPD Officer Dennis Guerra."

He went on to say, "We will bring the defendant to justice for these terrible and horrific crimes."

Officials say Dockery confessed to starting the fire because he was bored but his attorney, Jesse Young, wonders if thats true.

"Ultimately, a jury will have to decide whether those are his words or whether those were words given after intense questioning with a seasoned detective," says Young.

Officer Dennis Guerra and his partner took the elevator to the 13th floor of the residential high-rise during the fire, but they were overcome by smoke and carbon monoxide. The 38-year-old husband and father of four succumbed to his injuries Wednesday. His partner, officer Rosa Rodriguez, remains hospitalized in critical condition in the Bronx.

Dockery faces 25 years to life in prison if convicted of second-degree murder.
