NYPD officer disputes DWI, misconduct charges

THE BRONX - An NYPD officer from the 52nd Precinct who is accused of being drunk on the job is fighting DWI and official misconduct charges.

Richard Evans showed up late to his midnight shift on Dec. 8, prosecutors say. While allegedly drunk, he took his marked police car to respond to a call.

A judge released him on his own recognizance at his first court appearance Thursday.

When Evans arrived at the scene, prosecutors say someone there called police again out of suspicion that something was wrong. Prosecutors say Evans then took his squad car back to the 52nd Precinct building.

Evans was not given a Breathalyzer test, his lawyer says. But two 52nd Precinct sergeants and a captain deemed him unfit to perform his duties -- a decision that eventually led to his suspension from the force.

Evans faces up to a year in jail and a $1,000 fine if convicted. He is due back in court on March 7.
