Conviction overturned for Bronx man found guilty of murder
A Bronx man who was serving 25 years to life in prison after being convicted of murder is set to be released.
Steven Odiase, 31, was convicted by a jury in 2013 of second-degree murder and criminal possession of a weapon in the 2009 fatal shooting of 15-year-old Juan Jerez.
Odiase's lawyers asked the district attorney's Conviction Integrity Unit to review the case last year.
After looking at hundreds of documents and interviewing key witnesses, Odiase's attorneys, along with the Conviction Integrity Unit, discovered that a detective's form provided to the defense team was missing key information, including a witness' description of the shooter that did not match Odiase.
"He is still charged with the underlying murder," says Odiase's attorney, Pierre Sussman. "We are hopeful that the district attorney will see fit to dismiss his indictment on the grounds that they vacated the conviction today."
Odiase is due back in court June 13 to see if the indictment will be dropped. Until then, he can move on while the district attorney determines whether or not they will retry him in the case.
