The driver who fatally struck Christine Kenney-O'Rourke this past summer in Yonkers will not be facing charges.
Kenney-O'Rourke, a beloved lifelong resident of Yonkers known for her volunteer work, was killed just blocks away from her home while walking, as she often did.
The incident occurred when a 54-year-old White Plains woman drove across traffic, hitting Kenney-O'Rourke on the sidewalk. The driver then jumped a retaining wall and crashed into a home with three people inside.
Both the district attorney’s office and Yonkers police concluded, after separate investigations, that all evidence indicated this was a terribly tragic accident and not a criminal act.
Kenney-O'Rourke's family, however, has questions about the investigation, noting that the report mentions the driver had a missed call around the time of the crash but was never questioned about whether she was looking for her phone. "She was not intoxicated. The car was sound so what happened? Everyone who loved and knew my sister, we do not accept this," said Susan Henry, victim's sister.
Family and friends of Christine Kenney-O'Rourke state they will not rest until they get justice and are exploring other options.
