State Supreme Court Judge Rachel Tanguay dismissed a lawsuit filed by SMART Legislation that was seeking a hand recount in 2024 presidential and U.S. Senate election results in Rockland County.

Judge Tanguay's decision stated they "lacked standing" and other legal requirements.

In a statement to News 12, Rockland's Board of Elections says they plan to "continue to administer and certify election results in accordance with all applicable laws and procedures.”

"We consider this a victory, even though we didn't get a hand count. We got a tremendous amount of information in discovery," said Lulu Friesdat, with SMART Legislation.

She adds they learned about the way passwords to voting machines are handled, received conflicting information, among other things.

Friesdat says they are glad they brought the lawsuit,

"We want to emphasize the case was not dismissed on its merits," said Friesdat.

One of SMART Legislation's claims involved a third-party candidate for New York's U.S. Senate seat. Rockland resident Diane Sare had sworn affidavits from more voters than what is reflected in the result totals for two districts.
