A Bedford-Stuyvesant man is seeking $10 million in a notice of claim filed against the city Friday after his attorney says he was physically hurt and traumatized during an altercation with NYPD officers.
Attorney Sanford Rubenstein says his client Robert Bolden, 41, was exercising his First Amendment right during a counter-protest rally in Bay Ridge July 12.
He says things took a turn when NYD officers used a stun gun on Bolden and fractured his shoulder while they arrested him.
At the time, Bolden was recording another arrest when Black Lives Matter and Back the Blue Protesters clashed at the rally.
Video shows an officer shoving Bolden before getting into a scuffle. Bolden then says another officer hit him with a stun gun, causing him to fall to the ground.
After that, he says an officer twisted his arm behind his back, causing multiple injuries.
Police claim Bolden hindered their efforts.
Bolden claims he suffered serious injuries that have impacted his daily life.
He and his lawyer are asking for $10 million in a notice of claim, hoping a settlement with the city will help with his rising medical costs and emotional anguish.
"I suffered injuries to my shoulder, I got multiple fractures, 14 screws and a plate. I'm not able to walk no more or anything like that. All I ask is for justice and these officers be prosecuted," Bolden says.
Advocates are also demanding criminal charges against the officers involved.
At the time, NYPD told News 12 that the officer who tried to place Bolden under arrest fractured his wrist. They also say they will review the lawsuit when and if it is served.
