A Brewster man is planning to sue a village police officer after the two had an altercation that the man claims violated his civil rights.

The incident that was caught on camera and took place in a parking lot. It is now raising concerns about one Brewster Police Officer's alleged use of force.

Video taken by Brewster resident Alexander King appears to show Brewster Police Officer Fernando Quinones grabbing King's neck during an arrest last October.

King says the incident began when Quinones allegedly harassed him during a traffic stop.

He immediately went to the department to file a civilian complaint. King then claims Quinones put his hands on him to stop him from reporting.

"Officer Quinones knocks the phone out of his hand, grabs him by the neck, and throws him to the ground," says attorney John Tait.

King was charged with attempted assault, resisting arrest and disorderly conduct, according to his attorney - charges he claims the officer made up to cover for the unlawful arrest.

The officer claims King was cursing and making obscene gestures at him before allegedly following him back to headquarters.

Quinones claims King cursed at him again in the parking lot, but the video doesn't show that part of the incident.

"Mr. King is defending himself against these criminal charges all made up Mr. Quinones," says Tait

King's attorney says state police opened an investigation into the incident but believes it was closed without charges.

News 12 reached out to the Brewster Police Department and mayor's office for a comment but has not heard back.
