An NYPD officer is expected to face formal disciplinary charges for using excessive force while trying to handcuff a Bronx teen last year.

The city's Civilian Complaint Review Board has ruled that Sgt. Eliezer Pabon used too much force while arresting Javier Payne and a friend for allegedly punching a man in the face back in May of 2014. 

Pabon is accused of shoving the 14-year-old into a window outside a hookah shop, causing the glass to shatter and sending him to the hospital. Payne underwent more than four hours of surgery to remove shards from his body. 

Payne's family attempted to press criminal charges, but the Bronx District Attorney's Office decided not to pursue the case, ruling that the window had been compromised by bullet holes and cracks.

An attorney for Payne issued a statement saying in part, "We're pleased with the findings of the CCRB. This was a violent and excessive act by Sgt. Pabon, which caused excessive injuries to Mr. Payne." The family is now hoping to get the case back in criminal court. 

However, according to published reports, a lawyer for Pabon says the CCRB determination is merely a recommendation, and he predicts his client will be exonerated of any misconduct.
