The family of Delrawn Small, who was fatally shot by an NYPD officer in 2016, has been fighting for accountability and are calling on a judge to stop delaying the trial process. 

Small’s family stood outside of the Brooklyn Supreme Court on Monday, demanding the release of court documents that they say will be crucial in a disciplinary trial.  

The NYPD officer responsible, officer Wayne Isaacs, was acquitted of murder in Brooklyn Supreme Court in 2017 and continues to serve with the NYPD.  

In 2020, the Civilian Complaint Review Board substantiated charges against Isaacs, starting the process to hold a disciplinary hearing. Now, Small’s family says Brooklyn Supreme Court Judge Danny Chun has been delaying the release of documents from Isaacs’ 2017 criminal trial that they say could help the CCRB determine whether or not Isaacs violated NYPD policy . 

In a statement to News 12, the court said: 

“The judge will make a determination as to whether he will unseal documents from the trial after consideration in due time.” 

The disciplinary trial can move forward without the documents, but Small’s family insists that they will give the CCRB a more clear picture on what took place.  

Once the trial takes place, the CCRB can either recommend Isaacs’ firing or not, which will be decided on by the NYPD commissioner.
