After five intense years, Commissioner James O'Neill has fired officer Daniel Pantaleo, but now his attorneys are fighting back.

Pantaleo's attorney delivered the news Monday that Pantaleo will be appealing the police commissioner’s decision to terminate him, stating Pantaleo had been promised a pension for his 13 years in the department, but then later went back on that decision.

It seems Pantaleo is determined to keep fighting for his job, even after he was fired for placing Eric Garner in a chokehold in 2014 that lead to his death.

O'Neill delivered an emotional statement Monday, saying he was a beat cop for 34 years and said it could've been him in Pantaleo's position. After five years of investigations and protestsworldwide, O'Neill said his final decision came down to a recent recommendation of a department disciplinary judge, but it was ultimately his choice.

O'Neill addressed the city, saying he has not taken this verdict lightly and he understands many will disagree. Ultimately, he went on to say, it was a decision he had to make and at the end of the day there's no victors.

Shortly after the ruling, supporters joined Garner's mother as she held a press conference addressing the news she’s been waiting for five years.

"Yeah Pantaleo. You may have lost your job, but I lost a son," said Carr. "I lost my son.  You cannot replace that.  You can get another job.  Maybe at Burger King."
