A Parkchester homeowner has been given a sidewalk violation for a tree he didn’t plant.

Earl Estes says he was confused when he was given the violation because the city planted the tree eight years ago.

The tree is located up against the street and several feet away from Estes doorstep. He says the roots have since mangled the sidewalk, leaving pedestrians at risk of tripping and falling.

The violation from the city’s Department of Transportation says it is the homeowner's duty to repair the walkway in 45 days or less. Estes was concerned that simply placing some concrete on the area would be a Band-Aid fix and the tree would eventually continue to grow, causing more issues later on.

He says he has scheduled a another inspection and is looking into a program that conducts free tree and sidewalk repair, sponsored by the Parks Department.

Estes says he prefers getting the tree removed, and that he never even wanted it in the first place.
