Police sergeant found not guilty in fatal shooting of Bronx woman

THE BRONX -

An NYPD sergeant was found not guilty on all counts in the 2016 shooting death of a 66-year-old Bronx woman.

Sgt. Hugh Barry was charged with second-degree murder, manslaughter and criminally negligent homicide in the Oct. 18, 2016 death of Deborah Danner.

The sergeant had responded to a call of an emotionally disturbed woman in her Castle Hill apartment. Barry testified that he feared for his life because Danner was holding a bat and was about to swing it at his head.

The NYPD sergeant told the court he had no choice but to fire his gun. His union says the verdict proves Barry followed his training in dealing with an emotionally disturbed individual.

Barry showed little emotion in court as Bronx Supreme Court Judge Robert Neary read the decision. The judge said the prosecution failed to prove beyond a reasonable doubt that Barry intended to kill Danner, who was a paranoid schizophrenic.

The judge also said the prosecution did not prove that he committed a criminal act.
