DOB cites woman over Schuylerville driveway opening

A Schuylerville woman says the Department of Buildings cited her for her driveway opening -- which she says has been there since before she purchased her home.
"They're telling me that I didn't have a driveway," Christina Natiello says.
An appraisal she received before buying the house says it came with a driveway -- but the DOB says a curb cut is different. A curb cut is a dip in the sidewalk that allows a car to enter a driveway, according to the DOB's website.
According to the summons, the DOB has no permit on file for the cutout.
She bought her house five years ago and says she hasn't touched the curb. And since she's already trying to sell it, that's an added hassle.
"Conveniently, I'm selling my house right now," she says. "So now that I'm leaving, they want me to fix the curb?"
She has prospective buyers lined up but says she can't complete the sale with an open violation. She has to either obtain a work permit or rectify the issue.
The DOB says buyer beware.
"It's the responsibility of prospective owners to ensure that all aspects of a property are legal at the time of purchase," a spokesperson told News 12. "Any illegal conditions, such as an unpermitted curb cut, are the responsibility of the current property owners, regardless of when the conditions were created."
Natiello says she plans to fight the summons at a hearing next month.
