A man was spotted once again walking into a business with a swastika cap on his head.

A man was spotted once again walking into a business with a swastika cap on his head.
The man was seen at a Sunshine Bagels in Ardsley, just days after he was asked to leave the City Limits diner in White Plains because customers were so offended by what he was wearing.
The man, who wears a red yarmulke with a backward hand-drawn swastika on it, was looking to be served.

Workers tell News 12 they didn't notice the controversial hat, but customers did. They snapped a photo and sent it to News 12, insisting it may be free speech but that it’s painful to a lot of people.

The unidentified man drew attention last week during lunch rush at City Limits. Customers were so upset that they called the police, who escorted the man out of the diner. Police say they interviewed the man, but they had to set him free because as hateful as many believe his hat to be, he's not breaking any laws.

Pace Law School Professor Bennett Gershman insists by setting the man free, the police did the right thing, exercising his constitutional rights of free speech. But Gershman says under the law, business owners are under no obligation to serve him.
He adds that the state Constitution does have protected classes that can't be discriminated against, including race, color, religion, national origin and sexual orientation. Politics is not one of them.
