A high-profile New York lawyer has withdrawn himself from representing the family of a Staten Island father who died after being placed in a police chokehold. 
Attorney Sanford Rubenstein passed the case on to his law partner, Scott Rynecki, after a woman went public with claims that Rubenstein raped her. 
Rubenstein has not been arrested or charged, and denies any misconduct, but did not want the accusations to take focus away from Garner. 
Garner's family is suing the city and the NYPD for $75 million following the 43-year-old's death, which was captured on cellphone video back in July. A medical examiner ruled it a homicide. 
A grand jury will determine if criminal charges are to be filed against the officers involved.
