Azucena Simon says she was riding the subway to work at the Bay Plaza Mall Thursday afternoon when she realized she was alone in her train car with a homeless person who was fumbling with his pants. She also says the car smelled of drugs.
In the wake of recent subway crimes, Simon says she made a last-minute judgment call to switch cars.
Simon admits she moved while the train was still moving, which is illegal unless it is during an emergency. After moving cars, she says she was approached by police officers and questioned about why she moved.
Simon says she shared her experience with the officers, but they placed her in handcuffs and issued her a summons for moving between cars.
The police say Simon had been uncooperative and had demonstrated unsafe riding.
However, Simon describes the interaction as aggressive and overpowering. She shared her experience on social media and has garnered nearly 4,000 shares.
Simon says this incident raises the question of what constitutes an emergency and what should riders do if faced with similar situations.
Simon says she hopes to fight for her summons.
