A former DACA recipient was taken by Immigration and Customs Enforcement for a second time and flown to Louisiana, with his deportation back on schedule for Friday morning. 

Javier Castillo Maradiaga’s family says they are angry but not surprised. 

Maradiaga’s deportation planned early Monday morning was stopped by President Joe Biden’s 100-day moratorium on most removals, but that decision was overturned by a Texas judge and ICE took action. 

He was allowed a 20-second phone call Thursday and he called his sister, Dariela Moncada. 

“The reason, whatever they did, was a surprise to us,” said Alma Maradiaga, Javier’s mother. 

His family says his DACA status expired in 2019 and out of fear of sharing personal information, they say he didn’t renew. 

He’s been living in the United States since he was just seven years old. 

“I’m proud. I’m really proud to be his mom,” said Alma Maradiaga. 

Rep. Ritchie Torres says ICE should have gone through New York courts before processing Javier, though the Texas decision has been impacting cases throughout the country. 

"There’s no reason for the field director here in New York to deport Javier based on a court decision from Texas,” said Rep. Torres. 

News 12 has reached out to ICE for comment but has not heard back yet. 

Javier is slated to be sent back to Honduras Friday morning.
