A Bronx man accused of fatally shooting his building superintendent and wounding two others never made it to trial. His family saying he died by suicide on Rikers Island.
Police say 44-year-old Jimmy Avila surrendered hours after the shooting, which happened Aug. 27 at 1412 College Ave.
Avila called News 12 to say he felt threatened and failed by the system. Less than a day after his arraignment, he died by suicide at Rikers Island.
Avila’s family says he struggled for years with mental illness and should have been placed on suicide watch. They’ve filed a lawsuit against the city, demanding answers about how someone with mental health issues was left alone in a cell.
Avila's family says, his brother, a Correction Department Captain in Rikers’ West Facility, learned of his death when a department official came to his home. He then called the rest of the family to inform them of the tragedy.
“We all lost at this point,” said his brother, Alex Avila, who offered condolences to the families of the victims while also pushing for reforms to prevent future tragedies.
Those who loved Hines, who died in the shooting, told News 12 over the phone that the shooting has left their hearts broken.
