The family of a 10-year-old boy who died during a baseball game is getting ready to take legal action against the town of Hempstead over his death.

Lazar LaPenna's father, Gregg LaPenna, filed a notice of claim against the town Monday, which will likely become a lawsuit soon.

Lazar LaPenna died of a seizure during a baseball game at a Point Lookout park.

Greg LaPenna claims that the park and the ambulance that treated his son failed to provide equipment and training that could have saved the boy's life.

The main failure in the claim is that the town of Hempstead was not keeping a functioning automated external defibrillator, which the LaPennas' attorney says is a legally required piece of equipment.

Attorney Evan E. Richards says, "No amount of money can return Lazar to his family, but the LaPenna family is entitled to justice for the wrongful death of their son."

Richards went on to say, "Gregg also wants to make sure that every baseball field and other types of stadiums and fields have defibrillators moving forward as required by New York law."

LaPenna is seeking $10 million in damages in the claim.
