A Bronx activist who staged an unsuccessful bid to run for state Assembly is suing the woman he lost to, accusing her of election fraud. Maximino Rivera lost the September Democratic primary election to Assemblywoman Carmen Arroyo. Now, a nine-page lawsuit against Arroyo and the Board of Elections alleges that the incumbent assemblywoman engaged in illegal election tactics to sway voters at polling sites. The suit accuses Arroyo of interfering with poll worker duties and trying to gain more votes at poll sites. According to New York election law, candidates must stay 100 feet away from polling sites during elections. Rivera has filed the suit in state Supreme Court and he is hoping that a judge will grant a new election. Arroyo's office had no comment on the suit. The Board of Elections says it is aware of the legal proceedings and that it plans to fight the charges.
