Michael Valva's defense attorneys questioned Tuesday the lead detective who investigated the murder of Thomas Valva.
Sgt. Norberto Flores went to Long Island Community Hospital and the Valva home on the day the 8-year-old died.
Flores interviewed both the father and his ex-fiancee Angela Polina separately. He said they both told him at the hospital that Thomas Valva fell.
He also said that Michael Valva had cried at the end of the interview and put his head in his hands.
Both Michael Valva and Polina told the detective that none of the other children saw Thomas Valva the day he died, Flores said.
The prosecution claims that couldn't be true because a child can be heard in surveillance video from that day asking why Thomas Valva couldn't walk and another child asking if they should get Thomas Valva a granola bar to eat.
They claim that Thomas Valva and his brother were forced to sleep in the garage for months and it was below freezing the day he died.
The prosecution claims Michael Valva sprayed his son down with a hose that day.
The child's body temperature was 76.1 degrees when taken at the hospital.
