Thomas Valva's bus driver testified Friday that she did not see the 8-year-old on the day that he died.
Prosecutors have stated that Thomas Valva's father, ex-NYPD officer Michael Valva, told police his son fell while running to the bus stop and banged his head.
Jeanette Mitchell said she saw the other children running from their home to the bus stop on Bittersweet Lane the day that Thomas Valva died.
The driver said she asked the other children if Thomas Valva was coming, and they said no.
Mitchell drove all six of the children to and from school every day. She would get the middle school-aged children first and the younger ones after.
She described Thomas Valva, saying, "He was a good boy, listened to the rules."
The defense said that Mitchell's testimony is insignificant because she said only positive things about Michael Valva and that he was controlled by his ex-fiancee Angelina Polina.
The prosecution says Thomas Valva and his 10-year-old brother - both on the autism spectrum - were forced to sleep in the garage for months because they would have accidents urinating and defecating.
They say that the father sprayed Thomas Valva down with water outside during freezing conditions and that the boy's body temperature was 76.1 degrees when taken at the hospital.
The trial of Michael Valva will continue on Tuesday.
Polina will be tried separately in the death of Thomas Valva.
